HOUSE AMENDMENT NO. 1
TO
HOUSE BILL NO. 153
AMEND House Bill No. 153 by deleting the word “cigarettes” as it appears on lines 2, 3, 9, 12, 13, 14, 21, 31, 39, 44, 64, 81, 84, 99, 104, 109, 114, 129, 138 and in the Synopsis and by inserting in lieu thereof the words “any tobacco product”.
FURTHER AMEND House Bill No. 153 by deleting the word “cigarette” as it appears on lines 72, 77 and 120 and by inserting in lieu thereof the words “any tobacco product”.
FURTHER AMEND House Bill No. 153 by deleting lines 46 through 61 in their entirety and by inserting in lieu thereof the following:
“(1) receives both a copy of a valid form of government identification showing date of birth to verify the purchaser is age eighteen (18) years or over and an attestation from the purchaser certifying that the information on the government identification truly and correctly identifies the purchaser and the purchaser’s current address. Such attestation shall also confirm (A) that the prospective consumer understands that signing another person’s name to such certification is illegal; (B) that the sale of tobacco products, including cigarettes, to individuals under the legal minimum purchase age is illegal; and (C) that the purchase of tobacco products, including cigarettes, by individuals under the legal minimum purchase age is illegal under the laws of this State.
(2) delivers the tobacco product to the address of the purchaser given on the valid form of government identification and by a postal or package delivery service method that either limits delivery to that purchaser and requires the purchaser to sign personally to receive the delivery or requires a signature of an adult at the purchaser’s address to deliver the package.”.
FURTHER AMEND House Bill No. 153 by deleting the words “or by check” as they appear on lines 67 and 68 thereof.
FURTHER AMEND House Bill No. 153 by inserting a new Subsection 11 between lines 29 and 30 thereof to read as follows:
“(11) ‘Tobacco products’ means one or more cigarettes, herbal cigarettes or cigars, bidis, chewing tobacco, powdered tobacco, pipe tobacco, snuff or any other tobacco product.”.
FURTHER AMEND House Bill No. 153 by striking in line 34 the number “5263” and replace thereto with “5363”.
FURTHER AMEND House Bill No. 153 by striking in line 35 the number “5264” and replace thereto with “5364”.
FURTHER AMEND House Bill No. 153 by striking in line 36 the number “5265” and replace thereto with “5365”.
FURTHER AMEND House Bill No. 153 by striking in line 37 the number “5266” and replace thereto with “5366”.
FURTHER AMEND House Bill No. 153 by striking in line 38 the number “5267” and replace thereto with “5367”.
FURTHER AMEND House Bill No. 153 by striking in line 63 the number “5264” and replace thereto with “5364”.
FURTHER AMEND House Bill No. 153 by striking in line 71 the number “5263” and replace thereto with “5363”.
FURTHER AMEND House Bill No. 153 by striking in line 98 the number “5267” and replace thereto with “5367”.
FURTHER AMEND House Bill No. 153 by striking in line 131 the number “5263” and replace thereto with “5363”.
FURTHER AMEND House Bill No. 153 by inserting after “shall” on line 82:
“become affixing agents as defined by § 5301 of this Title and shall be eligible to receive commissions pursuant to § 5318 and further shall”.
SYNOPSIS
This Amendment expands the application of the Bill to all tobacco products rather than only cigarettes and strengthens the requirements regarding verification that the purchaser of a tobacco product is of legal age, corrects typographical errors regarding section numbers and requires that internet sellers become affixing agents with eligibility to receive commissions on stamps affixed.
